Terms of service

1. Purpose

These terms govern the use of the TruckDMS software (the "Service") offered by 9469-5947 Québec inc. (Evertrust Parts) ("we"), an online management software for commercial truck dealers, light to heavy duty. By creating an account you accept these terms on behalf of your business.

2. Account and access

You are responsible for keeping your credentials confidential and for actions taken with your account, including by users you invite. Notify us promptly of any unauthorised access.

The Service is for professional use by adults.

3. Trial, subscription and payment

A 14-day free trial is offered without a credit card. When the trial ends a paid plan is required to keep using the Service; your data stays readable and exportable for 90 days.

Plans are billed in advance, monthly or yearly, in the dealership's currency (Canadian dollars, or US dollars for a dealership in the United States) plus taxes, through our payment provider Stripe. You can change plan or cancel anytime from Billing; cancellation takes effect at the end of the paid period and no pro-rated refund is issued unless required by law.

We may change prices with 30 days' notice by email.

4. Your data

You remain the owner of all data you enter into the Service (inventory, customers, invoices, documents). You grant us only the licence needed to host, process and display it to you.

You can export all your data at any time. On written request after your subscription ends we delete your data within 30 days, subject to legal retention obligations.

You are responsible for the accuracy of the data and documents you produce with the Service (invoices, contracts, taxes). The Service applies the rates you configure; it does not replace an accountant or legal counsel.

5. Acceptable use

You may not use the Service for illegal activities, to transmit malicious content, to try to access another dealership's data or to bypass the limits of your plan. We may suspend an account in case of breach, with notice where reasonable.

6. Artificial-intelligence features

AI features (photo sorting, VIN reading, spec extraction, descriptions, estimates) produce suggestions that must be verified before use. They are not a professional appraisal. Images and documents submitted are sent to our model provider for processing and are not used to train its models. This data is stored in the United States and may be processed in other countries (see the privacy policy); do not submit identity documents.

7. Electronic signature

The Service lets you have contracts signed electronically within the meaning of Quebec's Act to establish a legal framework for information technology and equivalent laws. You are responsible for identifying your signatories and for the content of your contracts.

This electronic signature is meant for sale contracts. It is not suitable for registration or title forms, powers of attorney, promissory notes or security agreements, which may require a handwritten signature or the relevant registry's own system.

8. Availability and support

We aim for 99.5% monthly availability, excluding announced maintenance. Support is provided by email in French and English on business days.

9. Limitation of liability

To the extent permitted by law, 9469-5947 Québec inc. (Evertrust Parts) is not liable for indirect damages, lost profits or lost data, and its total liability is limited to the amounts paid for the Service in the 12 months preceding the claim.

10. Governing law

These terms are governed by the laws of Quebec and Canada. Disputes are submitted to the courts of the district of Montréal.
